New Jersey delays food-contact PCR mandate for plastic packaging to January 2030

The New Jersey Department of Environmental Protection has extended the exemption for food-contact rigid plastic packaging under the state's Recycled Content Law in a memorandum dated 4 September 2026, moving its expiry from 18 January 2027 to 31 December 2029, so post-consumer recycled content is required only from 1 January 2030. NJDEP said food-grade PCR technology is not yet at sufficient scale, described the supporting research as deliberative and confidential, and said it had not sought input from recyclers, suppliers, brand owners or manufacturers. Non-food rigid containers and beverage and glass containers are unaffected and still move to 20 per cent recycled content in 2027.

Why this mattersA three-year delay in one of the largest US state PCR mandates removes near-term demand certainty for food-grade recycled resin, a template other states have followed.

  • NJDEP's 4 September 2026 memorandum extends the food-contact rigid plastic packaging PCR exemption from 18 January 2027 to 31 December 2029, under N.J.S.A. 13:1E-99.144(b).
  • Non-food rigid plastic containers remain at 10% PCR, rising to 20% in 2027.
  • Plastic beverage and glass beverage containers have required 15% PCR since 2024, rising to 20% in 2027 and to 50% in later stages.
  • NJDEP cited limited food-grade PCR supply and technology readiness, and said the underlying research is deliberative and confidential.
  • Recycler Plastic Recycling Inc. says food-grade resin projects developed over two years have been paused and some supply deals cancelled.
  • APR, NAPCOR and The Recycling Partnership say NJDEP did not consult recyclers, suppliers, brand owners or manufacturers before issuing the extension.
  • NJDEP expects food-grade PCR availability and technology to be more robust by 1 January 2030 and has reserved the right to extend the exemption further.

Recycling Partnership report finds US household packaging stream lighter and more complex

The Recycling Partnership has published the second installment of its 2026 State of Recycling Report, based on its National Recycling Database and field measurement studies. The report finds that since 2020 US households have grown by 8.5 million while generation of traditionally collected recyclable material fell 3.7 million tons, or 8 percent, with plastics and cartons rising sharply and mixed paper and glass declining.

Why this mattersA lighter, more plastics-heavy household stream signals recyclers and processors need new sorting and end-market investment to keep pace with packaging design shifts.

  • US households grew by about 8.5 million since 2020
  • Generation of traditionally collected material fell 3.7 million tons (8 percent) since 2020, excluding film
  • Cardboard generation per household rose 32 percent, cartons rose 61 percent, nonbottle PET rose 48 percent, PP rose 47 percent, aluminium foil and trays rose 44 percent, aluminium cans rose 18 percent
  • Mixed paper declined 34 percent and glass declined 28 percent per household
  • Combined plastics (with film and flexibles) now represent 31 percent of generation, surpassing mixed paper at 28 percent
  • US households will generate 51.5 million tons of packaging and printed paper this year, 78 percent within traditionally collected categories
  • The report calls for additional investment in collection, sorting and processing capacity to match the changing packaging mix
  • Extended producer responsibility fees are cited as a potential funding source for infrastructure investment
  • Fewer than half of US recycling programmes accept aluminium foils and trays despite a 44 percent rise in their generation
  • Cardboard, metals and plastic containers grew from 39% to 51% of traditionally collected material generation between 2020 and 2026.
